06 / Dialer Intelligence

What are they dialing with?

Search any company for the outbound-dialing technology it likely uses, how the dialer works, whether it raises TCPA autodialer issues, and discovery pointers for building a claim.

07 / Dialer Technology Reference

How each dialer works — and why it matters.

The TCPA's autodialer definition turned on Facebook v. Duguid, 592 U.S. 395 (2021): a system is an ATDS only if it uses a random or sequential number generator. Use this to assess what a caller likely used.

Dials many numbers at once using a pacing algorithm that predicts when an agent will free up, connecting only answered calls and dropping the rest.

ATDSOften an ATDS. Post-Duguid, likely an ATDS if it stores or produces numbers using a random or sequential generator; dialing a fixed stored list alone may not qualify.
TCPAHigh abandonment; calls to mobile numbers need prior express consent.

The platforms behind the calls.

09 / Lead-Generation Data Trail

How they got your number.

Telemarketers rarely dial at random — they buy your number. Here's where it comes from and how to pull it back.

Where the data comes from
  • ·Public records — deeds, court filings, business licenses, voter rolls.
  • ·Form fills, sweepstakes, and warranty cards that bury consent in fine print.
  • ·App permissions and SDK data resale — games and utilities harvesting contacts.
  • ·Purchased lists and co-registration lead sites.
  • ·Phone-appending services that match a name to a wireless number.
  • ·Carrier directory-assistance and white-pages data.
  • ·Aggregation by data brokers (Acxiom, Experian, Epsilon, and others).
Key point

The Do Not Call Registry stops legitimate telemarketers — not data brokers. To slow the pipeline, opt out at the brokers themselves.

Turn dialer intelligence into an evidence package, a damages estimate, and a court-ready demand letter.
